A Judgment Creditor Does Not Have Standing to Remove an Executor for a Personal Debt
In the Orphans’ Court estate litigation and estate administration case of Estate of Martin, PICS Case No 14-0710 (C.P. Orphans’ Ct. Div. March 26, 2014) the Honorable John W. Herron ruled that a judgment creditor of the executor of a decedent’s estate had no standing to seek the removal of the executor because he had no claim against the estate and the will contained a spendthrift provision. Therefore, the judgment creditor’s petition to remove the executor was denied.
Capanna was a judgment creditor of the executor of the estate, who was decedent’s son and sole heir, and he sought the removal of the executor, which was granted. However, the executor filed a timely motion for reconsideration asserting that Capanna was not a creditor of the estate, but only of the executor personally. At the hearing, Capanna admitted that he had no judgment against the estate.
Capanna invoked §3183 of the PEF Code as a basis for standing and relied on In re Velott. However, Velott did not address the issue of whether the creditor of a beneficiary or an executor has standing to seek the removal of an executor. The analysis of standing in DiDio accorded with the well settled principle that the removal of the executor chosen by a testator is a drastic action and should be taken only when the estate is endangered. Here, Capanna sough the removal of the executor primarily to assure payment of a debt the executor owed to Capanna.
Additionally, the will contained a spendthrift provision providing that “until distributed, no gift or beneficial interest shall be subject to anticipation or to voluntary or involuntary alienation.” This article of the will was an impenetrable obstacle to any claim to standing that the creditor could assert.
Since the creditor admitted that he had no claim against the estate itself, he could not prevail in his effort to remove the executor.
